There are five "Heinous Crimes against the Person", crimes that satisfy one of the requirements laid down by the Supreme Court in Tennessee vs Garner. These Heinous Crimes are:
- Murder
- Attempted Murder
- Violent Sexual Assault
- Stranger Kidnapping
- Arson of an occupied building
When a rioter commits one of these, including the last, he or she has started down the path for extraordinary treatment under the law.
Setting fire to a building at a time when one or more people are within is not a property crime.
